New York Governor Andrew Cuomo has narrowed the definition of construction as an essential industry, closing all sites that are not emergency work or do not directly support efforts to fight the COVID-19 outbreak.

New York Governor Andrew Cuomo has mandated that all employers reduce their on-site workforce by 100%. This order does NOT apply to construction, but essential businesses must have rules that implement 6-foot social distancing. Civil fines and mandatory closures will be enforced for businesses that do not comply.

The governor has also suspended evictions an foreclosures on residential or commercial property for 90 days.

Members and contractors on active sites should follow CDC guidelines for preventing the spread of the virus. Members who have concerns about their health ad safety should talk to the carpenter steward on the job and/or their local union.

Quarantine Leave

New York Governor Cuomo has signed into law legislation which will allow workers employed on a project which has NOT shut down, but who have been quarantined due to COVID-19 to collect leave pay from a combination of employer, family leave and disability insurance funds. If you have been exposed to COVID-19, seeking medical attention and/or getting tested, you may qualify for this benefit. Contact your Local Union representative for more information. Below is a brief summary of the emergency legislation:

***Employee must be under a “mandatory or precautionary order” from NYS, DOH, Local Board or any other duly authorized government entity.

***Employees are able to collect full pay and job protection for the quarantine period at a maximum amount based on a $150,000 annual salary.

Employers with 10 or fewer employee and net income below $1 million: Employees will be paid from paid family leave and disability benefits for the duration of the mandatory/precautionary order

Employers with 10 or fewer employees and net income over $1 million AND Employers with 11-99 employees: Employer must provide 5 days of paid sick leave. After the 5 days, employees will be paid from paid family leave and disability benefits for the remainder of the mandatory or precautionary order.

Employers with 100+ employees & Public Employers: Employer must provide sick leave for the period of the mandatory/precautionary order up to a maximum of 14 days.

Per the current guidance: people who have questions about what to do regarding health concerns should contact their physician before going to the doctor’s office or hospital to be tested or treated. They should call 9-1-1 if they have a life-threatening medical emergency.

The governor has suspended mortgage payment and foreclosure suspensions, postponing residential and commercial evictions for 90 days. Federal and state tax deadlines have been moved to July 15.

Union operations

ALL training and events at training centers are closed. Apprentices that were scheduled for training weeks will be contacted by the program about rescheduling.

ALL monthly union meetings have been cancelled until further notice.

New York Fund Offices are closed to walk-in service. The Fund will continue to; process and update Health and Welfare eligibility; process all pension and annuity payments; process HRA reimbursements via the HRA app or portal.

The Fund may be limited to processing new applications.
